Your TS 85 is legal if submerged. There are no restrictions on what can be taken with them when set underwater

I’m seeing in regulation foot hold traps that ARE submerged may not have an inside spread greater than 8-1/4 in. The ts-85 shows 8-1/2 spread. I’m taking it that that’s the outside jaw spread ? Making the inside spread 8-1/4 Is that correct ?

I think you are correct, most manufacturers list the trap jaw spread to the outside, Ohio law is the inside, which makes a lot more sense.

Before the regulation update several years ago that allowed bigger, modified traps on land, there was actually no size restriction under water, so you could have gone to the extreme and set a #6 Newhouse, with no teeth, in the water and been perfectly legal. The TS-85 was the biggest, sensible beaver trap in production at the time and was measured when drafting the updated rules, you are good to go.
